Individuals in financial trouble have a number of different options available. These include:
- Negotiating with creditors;
- Refinancing;
- Working with a credit counseling service;
- Chapter 13 (A repayment program based upon your ability to pay, through the Bankruptcy Court);
- Chapter 11 (A restructuring program designed for businesses and individuals with extremely complex financial circumstances where a plan is negotiated and accepted by creditors);
- and, Chapter 7 (Bankruptcy where you attempt to discharge your debts in exchange for providing an accounting of your assets and your financial affairs).
Note that not every individual will be able to obtain bankruptcy relief under the present law. We will work with you to find the most appropriate course of action for your situation.
If you are looking for advice in these areas, please do not hesitate to contact me, I do not usually charge for the initial consultation. It would be helpful if prior to the consultation you review the 342b_Notice, and 527_Notice documents, and filled out the Bankruptcy_Interview_Form.
If you are interested in filing bankruptcy as an individual you need to take a credit counseling course. The following link will take you to a list of the qualified counseling courses in Minnesota:
